Spoke Herd Bicycle Rental Agreement and Policy

I hereby acknowledge and agree to the following rental agreement terms and conditions:

Bicycles are rented out clean and in proper working condition and must be returned in the same manner.

Helmets are included in the rental and are required to be worn at all times while riding bicycles rented from Spoke Herd. If a customer is seen riding a Spoke Herd rental bicycle without a helmet, they will be expected to return the bicycle immediately with no refund.

Bicycles are maintained on a daily basis. It is the responsibility of the client to check the bicycle at the store BEFORE setting out on any ride.

I agree to return the bicycle in a clean, undamaged condition to avoid any additional charges for repair, maintenance, or replacement accept use of the equipment, as is, in good condition and accept full responsibility for care of the equipment while under my possession. Damaged parts or components will be repaired or replaced at the shop, Spoke Herd discretion and I, the customer, agree to pay regular shop rates and retail prices for the components replaced. Clean condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seat, and other parts from misuse and/or crashes.

Note: All bicycles should be returned clean of mud and debris.

Hourly or daily rentals are due back 15 minutes before closing time. Late returns are subject to fees.

Our Community stores have various packages available on hourly basis, and hence the prices for online/in-store may differ. 

Being a Spoke Herd Member/Spokie - we are keeping all online bookings at a fixed rate.

These rates are only for online bookings or pre-bookings.

A deposit Rs 5000/- per day of shall be paid before the Hire commences and shall be refunded upon return of the equipment subject to the following terms: The deposit is to be held against any theft, loss, damage, or failure to return the equipment by the specified time and date. If not returned by the specified time and date, the cost of hire shall be charged on a pro-rata basis until it is returned. If not returned, I, the customer is liable to pay the entire MRP of bike or legal actions. Any late return, replacement or repair costs or insurance excess payments may be subject to fees.

The customer agrees to provide Spoke Herd with his/her Original Govt. ID details and copy of ID, for precautionary use only.

I, authorize Spoke Herd to keep my original Govt ID during my rental period. In case of theft, I will be responsible for reimbursing Spoke Herd for the original price of the bicycle (s) plus the cost of any accessories that were provided at the time of the bicycle rental.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT

Assumption of risk: I understand and accept that renting this bicycle and participating in bicycling exposes me to many hazards that may entail unavoidable risk such as death, personal injury (including but not limited to severe spinal and head injury) and loss or damage to property. I also understand that I should be in good physical health to participate in bicycling, and I confirm that I have no medical conditions, nor have I been diagnosed with a condition that prevents me from bicycling.

In spite of the aforementioned risks and acknowledgements, I hereby assume all risk or injury or loss of life to myself and loss of damage to property arising out of renting this bicycle and participating in bicycling. I understand the inherent risk involved in using this rental bicycling equipment and accept full responsibility for any and all such damage or injury which may result.

Waiver and Release: In consideration of Spoke Herd renting me this bicycle, I specifically release and forever discharge Spoke Herd and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of damage to property which I may suffer while renting this bicycle(s) and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death, or damage caused by the negligence of Spoke Herd or its affiliates, officers, agents, or employees.

It is my intent by Waiver and Release Agreement to release Spoke Herd and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Spoke Herd or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle(s) or participating in bicycling, I will have no right to make a claim or file a lawsuit against Spoke Herd or its affiliates, officers, agents or employees, even if they or any of them negligently cause my injury, illness, death.

Please initial the following: 

I realize the importance of wearing a helmet. A helmet must be always worn.

I understand that this activity may result in severe injury, including but not limited to spinal or head injury.

I understand that this activity may result in hazards posed by other bicycles and traffic on road conditions.

Spoke Herd staff has answered any and all questions I had.

I understand these bicycles may not have visibility enhancement equipment such as Blinking lights.
